Debt Relief Under Chapter 7 of the Bankruptcy Code

In a Chapter 7 bankruptcy proceeding, the debtor can discharge certain debts in exchange for full disclosure and, in some instances, the sale or liquidation of specific assets. The process typically takes about 90 days.

Under 2005 changes to the federal bankruptcy law, individuals seeking to file under Chapter 7 must meet certain income eligibility requirements or pass a means test. If you are unable to pass the means test, bankruptcy under Chapter 13 may still be an option for you.

Chapter 7 Debtors

If you are a debtor with a significant amount of unsecured debt, such as credit card or medical bills, or if you have assets you are willing to liquidate in exchange for discharge of your debt, Chapter 7 may offer you the debt relief you need.
